Water Always Finds Its Level: The Maryland Workers’ Compensation Commission Publishes 2022 Rates

In 2021, Employers and Insurers were pleasantly surprised to see Maryland workers’ compensation rates decrease by approximately 3%. Unfortunately, 2022 will bring a market correction to the State average weekly wage and, ultimately, benefits due and owing to claimants.

In 2022, compensation rates will increase across all categories. The State average weekly wage will increase from $1,050.00 to $1,338.00, effectively raising maximum compensation rates for high-earning claimants. Additionally, first-tier permanent partial disability benefits will now be paid at the weekly rate of $224.00. Relatedly, second-tier permanent partial disability awards will now be paid at the weekly rate of $446.00.

The publication of this information brings with it the responsibility of employers and insurers to increase their reserves for workers’ compensation claims involving accident or disability dates in 2022. From a legal standpoint, it is now, more than ever, important to develop creative and aggressive legal defenses to mitigate exposure for employers and insurers.
